Flamengo has filed a request with Brazil's Supreme Court to join ADI nº 8.027/DF as an amicus curiae, contributing technical expertise to the constitutional debate surrounding Provisional Measure nº 1.394/2026. The filing positions the Club as one of the sports institutions directly affected by the measure, seeking to inform the Court's deliberations from a practical standpoint.
The Club's submission addresses specific impacts of the Provisional Measure on Brazilian sports financing, existing sponsorship contracts, the sustainability of Olympic and youth development programmes, and the legal security of agreements established under the current regulatory framework.
Flamengo emphasises that its intervention does not represent a narrow defence of contractual interests. Rather, the Club aims to provide the Supreme Court with comprehensive insight into the concrete consequences of the legislative change across the entire sports ecosystem, particularly given the scale and timeline of the Provisional Measure's projected effects.
Flamengo reaffirms its openness to sector regulation and improvement. However, the Club maintains that changes of this magnitude must uphold constitutional principles of legal certainty, protection of legitimate expectations, and promotion of sport, while accounting for the impact on contracts and investments made under rules established by the State itself.
